Announcement - Attached is a decision argued by our very own David Case that stands for the proposition that, at least in St. Lawrence County, New York, an assignment can be dated after the commencement of the action, and relate back to an earlier date.  It holds that unless the defendant offers proof in rebuttal, the plaintiff has standing to bring the foreclosure action. AlertNotice of Court Closure.  U.S. Bankruptcy Court Eastern District of New York (Brooklyn Office) Moving and District Closed from 9/8/05-9/12/05.

Please be advised that the U.S. Bankruptcy Court for the Eastern District of New York (Brooklyn Office) will be moving its operations and Judges to a new location as of Tuesday, September 13, 2005. Due to this relocation, the Clerk's Office will be closed from Thursday, September 8 through Monday, September 12. The Court's ECF/PACER system will also be unavailable for filing purposes district-wide during this time. This means that we will not be able to file any documents (including Proof of Claims, Motion for Relief's, Objections, etc.) with the Court in the Eastern District which includes the Brooklyn and Central Islip Offices during this time.
